Terms of Service & Program Agreement

Effective date: October 12, 2026

Service provider: Alena Dushenko, operating alenanutrition.com

Business contact: dushenko.alena@gmail.com | 34 S Willow Point Circle, The Woodlands, Texas, 77382

1. Agreement and Scope

These Terms of Service & Program Agreement (the “Agreement”) govern purchase of the Private Wellness Program through alenanutrition.com. By enrolling, the client engages the service provider identified above for individualized nutrition and wellness advisory services. The program is not medical care.

2. Program and Price

The Private Wellness Program costs $1,450 and includes four weeks of private one-on-one support, a comprehensive personalized wellness guide with nutrition, lifestyle, and supplement recommendations, chef-ready menus when applicable, an approved laboratory testing panel with an at-home blood collection option included, and wearable data insights when applicable. Physical supplements are purchased separately. During the four-week support period, clients may submit unlimited program-related questions through the private client portal, ordinarily answered within 24 business hours. Progress is reviewed and recommendations are adjusted as needed. After completion, the client will receive an optional personalized offer for continued support; there is no automatic renewal.

3. Laboratory Services

After review of the completed intake form, a personalized laboratory panel is prepared for client review and approval. Once approved, the client receives the laboratory requisition online, and testing arrangements are coordinated. The approved laboratory testing panel and at-home blood collection option are included in the program fee. Additional tests outside the approved panel require advance disclosure of pricing and client authorization.

4. Supplements

Selection of recommended products and individualized instructions are included. Physical supplements are purchased separately. Product availability, fulfillment, delivery, and return terms may be governed by the supplying merchant. Clients should disclose all medicines, supplements, allergies, and relevant medical conditions and consult their physician or pharmacist when appropriate.

5. Wearable Data

Compatible wearable data may be reviewed as contextual wellness information. Collecting sufficient device data may take up to 10 days. Wearables are not used for medical diagnosis, and a wearable device is not required to enroll.

6. Program Timeline and Communication

The completed Personalized Wellness Guide is delivered within 2–3 business days after receipt and review of all required information: the completed intake form, laboratory test results, and wearable device data if applicable. Wearable data collection may take up to 10 days. The four-week private support period begins on the start date confirmed during onboarding. Clients may ask unlimited program-related questions through the private client portal during those four weeks; responses are ordinarily provided within 24 business hours. Progress and recommendations are reviewed and adjusted as needed. Emergency or 24/7 medical support is not provided.

7. Client Responsibilities

The client agrees to provide accurate information, notify the provider of material health changes, follow appropriate medical advice, and use secure designated channels for sensitive information. Client participation and results vary. No particular health outcome is guaranteed.

8. Professional Scope

Services consist of nutrition education and wellness guidance, not diagnosis, prescribing, or treatment of disease. Nothing in the program replaces advice from a licensed physician or other qualified clinician. In emergencies, call 911 in the United States.

9. Payment, Cancellation and Refunds

Payment is due under the checkout terms. The separate Cancellation & Refund Policy is incorporated into this Agreement. If you are dissatisfied with the services provided, you may request a partial refund equal to 40% of the $1,450 program fee ($580) within seven (7) calendar days after delivery of your completed Personalized Wellness Guide. The remaining 60% ($870) is non-refundable, except where applicable law requires otherwise. The seven-day period begins on the date the completed guide is delivered to the client, not on the purchase date or the date the intake form is submitted. Submit a written refund request to dushenko.alena@gmail.com within this period, identifying your name, order reference, and the reason for dissatisfaction. Eligible refunds are issued to the original payment method. This policy does not restrict non-waivable consumer rights or remedies under applicable law.

10. Intellectual Property and Use

Client-facing plans and educational materials are provided for the client’s personal use only and may not be resold or redistributed without written permission. The client retains ownership of materials they submit, subject to the permissions needed to provide services.

11. Limitations and Applicable Law

To the extent permitted by applicable law, the provider is not responsible for outcomes beyond the scope of services or for independently operated third-party products and services. Nothing here excludes rights or liabilities that cannot legally be waived. Governing law: the State of Texas.

12. Changes and Contact

The version accepted at checkout governs that purchase, subject to applicable law. Material changes for future purchases will be dated and published. Questions: dushenko.alena@gmail.com.
